Welcome to Tonmly! These Terms of Service ("Terms") govern your use of our URL shortening, email forwarding, profile pages, and related services (collectively, the "Services") operated by Tonmly Inc. ("Tonmly," "we," "us," or "our").

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these Terms, you may not access or use our Services.

Important: These Terms include provisions that limit our liability and require disputes to be resolved through binding arbitration rather than in court.

Tonmly provides the following services:

URL Shortening

• Convert long URLs into shorter, more manageable links
• Custom short link creation and management
• Link analytics and tracking
• QR code generation for shortened URLs

Email Services

• Email alias creation and management
• Email forwarding to designated addresses
• Spam filtering and quarantine management
• Email Scout Reports and analytics

Profile Pages

• Personal profile page creation and customization
• vCard generation and contact information sharing
• Social media and website link aggregation
• Profile analytics and visitor tracking

Domain Services

• Custom subdomain assignment (premium feature)
• DNS management and configuration
• SSL certificate provisioning

We reserve the right to modify, suspend, or discontinue any part of our Services at any time with reasonable notice.

Account Creation

To access certain features, you must create an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Keeping your account information current and accurate

Account Eligibility

• You must be at least 13 years old to create an account
• You must provide accurate registration information
• You may only create one account per person
• Corporate accounts must be created by authorized representatives

Account Termination

You may terminate your account at any time by contacting us or using account deletion features. We may suspend or terminate accounts that violate these Terms or engage in prohibited activities.

Permitted Uses

Prohibited Activities

You may NOT use our Services to:

Illegal or Harmful Content

• Share illegal content or engage in criminal activity
• Distribute malware, viruses, or harmful software
• Engage in fraud, scams, or deceptive practices
• Violate intellectual property rights

Spam and Abuse

• Send unsolicited bulk emails or spam
• Create misleading or deceptive shortened links
• Engage in phishing or social engineering attacks
• Harass, threaten, or abuse other users

Platform Abuse

• Attempt to circumvent security measures
• Overload our systems with excessive requests
• Create multiple accounts to evade restrictions
• Sell, transfer, or share your account credentials

Adult and Inappropriate Content

• Share pornographic or sexually explicit material
• Distribute content harmful to minors
• Post violent or disturbing content
• Share discriminatory or hateful material

Content Monitoring

While we don't pre-screen all content, we reserve the right to monitor, review, and remove content that violates these Terms. We may use automated systems to detect prohibited activities.

Your Content

You retain ownership of content you create or upload to our Services ("User Content"), including:

• Profile information and customizations
• Links and URL destinations
• Contact information and vCard data
• Custom domain configurations

License to Tonmly

By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to:

• Store, process, and transmit your content
• Provide our Services effectively
• Generate analytics and insights
• Ensure security and prevent abuse

This license ends when you delete your content or terminate your account, except for content shared publicly or stored in backups for a reasonable period.

Responsibility for Content

• You are solely responsible for User Content you submit
• You represent that you own or have permission to use all content
• You will not submit content that infringes third-party rights
• We are not responsible for User Content or linked websites

Our Intellectual Property

The Tonmly platform, including software, design, trademarks, and content, is owned by Tonmly Inc. and protected by intellectual property laws. You may not copy, modify, or create derivative works without permission.

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Data Processing

• We process your data to provide and improve our Services
• We implement security measures to protect your information
• We comply with applicable privacy laws (GDPR, CCPA, PIPEDA)
• We do not sell your personal information to third parties

Analytics and Tracking

We collect analytics data to improve our Services, including:

• Link click statistics and geographic information
• Profile page views and interaction data
• Email forwarding statistics and spam metrics

Data Retention

We retain your data as described in our Privacy Policy. You can request data deletion or export through your account settings or by contacting us.

Free and Premium Services

We offer both free and premium subscription tiers:

• Free accounts include basic URL shortening and profile features
• Premium subscriptions unlock advanced features, custom domains, and enhanced analytics
• Feature availability may change with reasonable notice

Billing Terms

• Subscription fees are billed in advance on a recurring basis
• You authorize us to charge your payment method automatically
• Prices may change with 30 days' notice to active subscribers
• No refunds for partial months or unused portions of subscriptions

Cancellation

• You may cancel your subscription anytime through account settings
• Cancellation takes effect at the end of your current billing period
• You retain access to premium features until subscription expires
• Your account reverts to free tier limitations after cancellation

Payment Issues

If payment fails, we may suspend premium features until payment is resolved. Accounts may be terminated for repeated payment failures.

Service Uptime

While we strive for high availability, we do not guarantee uninterrupted service. Our Services may be temporarily unavailable due to:

• Scheduled maintenance and updates
• Technical difficulties or system failures
• Third-party service disruptions
• Security incidents or abuse prevention

Support

• Free users receive community support and documentation
• Premium subscribers receive priority email support
• We aim to respond to support requests within 48 hours
• Support is provided in English during business hours

Service Modifications

We may modify, update, or discontinue features with reasonable notice. Significant changes to core functionality will be communicated in advance.

Service Disclaimers

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT AND TITLE
• ACCURACY, RELIABILITY, OR COMPLETENESS
• UNINTERRUPTED OR ERROR-FREE OPERATION

Third-Party Content

• We are not responsible for content on linked websites
• Shortened URLs may lead to harmful or inappropriate content
• Users access third-party content at their own risk
• We do not endorse or control external websites

Data Loss

While we implement backup systems, you are responsible for maintaining copies of important data. We are not liable for data loss or corruption.

Security

Despite our security measures, no system is completely secure. You use our Services at your own risk regarding data security and privacy.

Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Tonmly AND Tonmly INC. SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES
• PERSONAL INJURY OR PROPERTY DAMAGE
• DAMAGES ARISING FROM USE OF OUR SERVICES

Damage Cap

OUR TOTAL LIABILITY FOR ANY CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

Indemnification

You agree to indemnify and hold us harmless from claims arising from:

• Your use of our Services
• Your User Content or linked websites
• Your violation of these Terms
• Your infringement of third-party rights

Jurisdictional Variations

Some jurisdictions do not allow limitations on warranties or liability. In such cases, our liability is limited to the extent permitted by applicable law.

Termination by You

• You may terminate your account at any time
• Cancellation can be done through account settings or by contacting us
• Subscription charges continue until the end of the current billing period
• Your data will be deleted according to our retention policies

Termination by Tonmly

We may suspend or terminate your account for:

• Violation of these Terms or our policies
• Illegal or harmful activity
• Repeated payment failures
• Abuse of our Services or systems

Effect of Termination

• Your access to our Services will cease immediately
• Shortened URLs may become inactive
• Email forwarding will stop functioning
• Your profile pages will become inaccessible
• You remain liable for charges incurred before termination

Data Retention After Termination

We may retain certain data for legal, security, or backup purposes as described in our Privacy Policy, but will delete personal information within reasonable timeframes.

Governing Law

These Terms are governed by the laws of Canada and the Province of Ontario, without regard to conflict of law principles.

Dispute Resolution

Most disputes can be resolved through our support team. For formal disputes:

• You agree to first attempt resolution through good faith negotiation
• Disputes shall be resolved through binding arbitration
• Arbitration will be conducted in Ontario, Canada
• Small claims court remains available for qualifying disputes

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full effect.

Entire Agreement

These Terms, together with our Privacy Policy and other referenced policies, constitute the entire agreement between you and Tonmly.

Assignment

We may assign these Terms in connection with a merger, acquisition, or sale of assets. You may not assign your rights without our written consent.

Waiver

Our failure to enforce any provision does not constitute a waiver of our rights to enforce that provision in the future.

Updates to Terms

We may update these Terms from time to time to reflect:

• Changes in our Services or business practices
• Legal or regulatory requirements
• Security or technical improvements
• User feedback and experience enhancements

Notification of Changes

When we make significant changes:

• We'll notify you via email or in-app notification
• We'll post updated Terms on our website
• We'll update the "Last Updated" date
• Changes become effective 30 days after notification

Continued Use

Your continued use of our Services after Terms changes become effective constitutes acceptance of the updated Terms. If you disagree with changes, you may terminate your account.
